1. Introduction

Welcome to QR Punk. By accessing and using our QR code management service at qrpunk.com, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

QR Punk provides dynamic QR code generation, management, and analytics services. These terms govern your use of our platform, including all features, tools, and services we offer.

2. Acceptable Use Policy

You agree not to use our service to create or link to content that:

4. Subscriptions

QR Punk offers subscription-based service plans billed on a monthly or annual basis. When you subscribe:

  • Your subscription automatically renews at the end of each billing cycle unless you cancel
  • You authorize us to charge your payment method for renewal fees
  • You can cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of your current billing period

5. Fee Changes

We reserve the right to modify our pricing and subscription fees. If we change fees for your subscription plan, we will provide at least 30 days advance notice before the changes take effect. Your continued use of the service after the fee change constitutes acceptance of the new fees.

6. Refunds

7. Accounts

When you create an account with us:

  • You are responsible for maintaining the security of your account credentials

Our service allows you to create QR codes that link to third-party websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

9. Termination

We may terminate or suspend your account and access to our service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the service will immediately cease
  • Your QR codes may stop functioning
  • We may delete your account data in accordance with our retention policies

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless QR Punk, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or link to using our service

11. Limitation of Liability

To the maximum extent permitted by law, QR Punk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the service
  • Any conduct or content of any third party using the service
  • Unauthorized access, use, or alteration of your content

12. Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QR PUNK MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue in such courts.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide at least 30 days notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
